IA filed comments on the Australian government’s mandatory code for digital platforms to bargain with news publishers. The draft code is in tension with US trade and digital policy as it has evolved since the Australia-U.S. Free Trade Agreement (AUSFTA), as reflected in the USMCA and other recent U.S. agreements. It lays the groundwork for other countries to follow, and is at odds with Australia’s own pro-digital goals. If it is enacted in its current form it would violate Australia’s trade obligations in the AUSFTA and the WTO General Agreement on Trade in Services (GATS).
